Kidz Biz Market — Minor Participant Liability Waiver, Assumption of Risk, Indemnity, Refund Policy & Media Release

I am the parent/legal guardian of the child/ren listed in this registration. In consideration of the Minor’s participation as a vendor/participant at Kidz Biz Market (the “Event”) organized by the Mississippi Microschool Freedom Movement (MSMSFM) and/or Libertarians for Learning, together with their officers, directors, employees, agents, volunteers, sponsors, partners, and the venue/host location (collectively, the “Released Parties”), I agree for myself, the Minor, and our heirs and assigns as follows:

1) Assumption of Risk

I understand the Event involves typical marketplace activities (set-up/tear-down; operating a booth; handling products, displays, and cash; interacting with crowds; moving through parking areas; exposure to weather and environmental conditions). Risks include, without limitation: slips/trips/falls; cuts or burns from tools or displays; contact with allergens or foodborne illness; theft, loss, or damage to property; interactions with other attendees; vehicle movement during load-in/out; and exposure to communicable diseases. I knowingly and voluntarily assume all such risks for the Minor and myself.

2) Release & Waiver

To the maximum extent permitted by Mississippi law, I release, waive, and discharge the Released Parties from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, including those arising from the ordinary negligence of any Released Party, related to or in any way connected with the Minor’s participation in the Event or presence on the premises, except claims resulting from gross negligence or willful misconduct.

3) Indemnification / Hold Harmless

I agree to defend, indemnify, and hold harmless the Released Parties from and against any claims or demands (including third-party claims), damages, fines, penalties, and reasonable attorneys’ fees arising out of the Minor’s participation, our acts or omissions, our booth/products, or any breach of this agreement.

4) Medical Authorization & Health

In an emergency, I authorize the Released Parties to obtain first aid and emergency medical care for the Minor and agree to be financially responsible for all related costs. I certify the Minor is in suitable health to participate. I will not bring the Minor if sick/fevered/contagious and will comply with any posted or communicated health/safety rules.

5) Supervision & Rules

The Minor, if under 13 years of age, must remain under my supervision (or a designated supervising adult) at all times. We will follow all rules, staff/volunteer instructions, and venue policies, including load-in/out procedures, fire/life-safety rules, and restrictions on prohibited or hazardous items/equipment. We are solely responsible for our cash handling, products, displays, and equipment and for securing our area against tipping, tripping, and other hazards.

6) Products & Compliance

We are solely responsible for the safety, legality, and labeling of our products and for complying with applicable laws, regulations, venue and event policies. We will promptly remove any item deemed unsafe or non-compliant by Event or venue staff.

7) Property Loss

The Released Parties are not responsible for theft, loss, or damage to our personal property, inventory, displays, vehicles, or equipment.

8) Refunds & Transfers

All registration fees are non-refundable. If a participant is unable to attend a market after registering, the fee may be applied as a credit toward another upcoming Kidz Biz Market event (subject to space availability), provided advance notice is given to the organizers. No refunds will be issued for cancellations, no-shows, weather-related changes, or event modifications.

9) Weather / Unforeseen Changes

The Event may be modified, postponed, relocated, or canceled due to weather, safety, or other causes beyond the control of the Released Parties. Fees are non-refundable but may be transferred to another market per Section 8.

10) Photo & Media Release

I grant permission to the Mississippi Microschool Freedom Movement (MSMSFM), Libertarians for Learning, and Kidz Biz Market organizers (“Released Parties”) to photograph, record, and otherwise capture the likeness, image, voice, or statements of my child during the Event. I understand these photos, videos, or recordings may be used for educational, promotional, fundraising, or publicity purposes in print, digital, or online formats, including but not limited to websites, social media, newsletters, flyers, and press releases.

I waive any right to inspect or approve the final use, and I release and hold harmless the Released Parties from any claims, demands, or liability related to the use of such media, including any claims of compensation, ownership, or misuse. I acknowledge that these images may be edited, copied, exhibited, published, or distributed, and may be used without further notice. I understand that no royalty, fee, or other compensation will be provided to me or the Minor. This release is perpetual, worldwide, and irrevocable.

11) Governing Law; Severability

This agreement is governed by Mississippi law. If any term is found unenforceable, the remaining terms remain in effect. This document is intended to be as broad and inclusive as Mississippi law permits.
